Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of https://1mkt.io and the design and development subscription services provided by 1MKT.io (“1MKT,” “we,” “us”), a brand of Virtuoso Design Studio, Las Vegas, Nevada. By subscribing to a plan or using this website, you agree to these Terms.
1. Services
1MKT provides design, development, and marketing services on a flat-rate monthly subscription basis. Subscribers submit requests through our task board system. The number of requests that may be in progress at one time depends on your plan:
- Standard — one active request at a time
- Plus — two active requests at a time
There is no limit on the total number of requests you may submit during a billing period. Once a request is completed, you may immediately submit the next.
2. Turnaround Times
Most requests are completed within two business days. Turnaround estimates are good-faith targets, not guarantees. Complex requests — such as full website builds, multi-page designs, or custom development — may take longer, and we will communicate expected timelines for these.
3. Billing and Payment
Subscriptions are billed monthly in advance through Stripe at the rate for your selected plan. Your billing period runs 28–31 days depending on the month, beginning on your signup date. By subscribing, you authorize us to charge your payment method on a recurring basis until you pause or cancel.
If a payment fails, we may suspend services until payment is resolved.
4. Pausing and Cancellation
You may pause or cancel your subscription at any time through the client billing portal or by contacting us. If you pause or cancel mid-cycle, you retain access to services through the end of the current billing period, and you will not be charged for subsequent periods. Paused subscriptions may be resumed at any time.
Because the subscription provides unlimited requests within each billing period, payments already made are non-refundable except where required by law.
5. Client Responsibilities
You agree to provide the materials, information, brand assets, access, and feedback reasonably needed to complete your requests. Delays in providing these may delay delivery. You are responsible for ensuring that any content or materials you supply do not infringe the rights of any third party.
6. Ownership and Intellectual Property
Upon payment for the applicable billing period, all final deliverables created specifically for you are owned by you. We retain ownership of pre-existing tools, code libraries, frameworks, and processes used to create deliverables, and grant you a license to use them as incorporated in your deliverables.
Stock photography and third-party assets included in deliverables are provided under the terms of their respective licenses. We reserve the right to display completed work in our portfolio and marketing materials unless you request otherwise in writing.
7. Acceptable Use
You may not use our services to create or distribute content that is unlawful, infringing, defamatory, deceptive, or that we reasonably determine to be harmful. We may decline requests that fall outside the scope of our services or that violate this section.
8. Third-Party Services
Deliverables may rely on third-party platforms (such as WordPress, Shopify, hosting providers, or plugin vendors). We are not responsible for changes, outages, or pricing decisions made by third parties.
9. Warranties and Disclaimer
Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant any particular business outcome, search ranking, or performance result.
10. Limitation of Liability
To the fullest extent permitted by law, 1MKT’s total liability arising out of or relating to the services or these Terms shall not exceed the amounts you paid to us in the three (3) months preceding the event giving rise to the claim. In no event will we be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost data.
11. Indemnification
You agree to indemnify and hold harmless 1MKT and Virtuoso Design Studio from claims arising out of materials you supply, your use of deliverables, or your breach of these Terms.
12. Termination
We may suspend or terminate services for non-payment, breach of these Terms, or abusive conduct toward our team. Upon termination, sections concerning ownership, disclaimers, limitation of liability, and indemnification survive.
13. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Clark County, Nevada.
14. Changes to These Terms
We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
